The agreement between you and Heirloom Prints when placing an order
These Terms and Conditions govern your use of any Heirloom Prints storefront and your purchase of products through it. Please read them carefully. By placing an order, you agree to be bound by these terms.
Heirloom Prints is operated by The Munna Co Pty Ltd (ABN 14 660 483 581), registered in Australia. References to "we", "us", or "Heirloom Prints" mean this entity.
Heirloom Prints is the retailer of all products sold through our network of authorised photographer storefronts. When you purchase a print, you are purchasing from Heirloom Prints — not from the photographer whose website you are visiting.
Heirloom Prints operates a network of authorised professional photographers who present and sell our products through personalised storefronts embedded on their websites. These photographers are authorised resellers who earn a commission on each sale they facilitate.
Transparency notice: The photographer through whose storefront you purchase earns a commission on your sale. This is disclosed in accordance with Australian Consumer Law. The commission is factored into our pricing and does not result in any additional cost to you.
All prices are set by Heirloom Prints and are consistent across every photographer in our network. Individual photographers are not permitted to offer discounts, promotions, or any pricing that differs from our published rates. If you are offered a price that differs from what appears on the official Heirloom Prints storefront, please contact us immediately at info@heirloomprints.com.au.
Orders are placed through the Heirloom Prints storefront embedded on an authorised photographer's website. The order process involves:
Your order is confirmed when you receive an order confirmation email from Heirloom Prints. This email constitutes acceptance of your order and forms a binding contract between you and Heirloom Prints, subject to these Terms.
You are responsible for ensuring that your uploaded photograph and all order specifications are correct before submitting your order. As each print is custom-made to your specifications, we are unable to accommodate changes after production has commenced.
We will advise you if your uploaded photograph is of insufficient resolution for your selected print size before we proceed. We will always present alternatives and options — we will never simply reject an upload without guidance.
All prices are displayed in Australian Dollars (AUD) and include GST where applicable.
Payment is processed securely by Stripe. Heirloom Prints does not store your payment card details. By completing payment, you authorise the charge to your nominated payment method.
Your payment is taken at the time of order placement. In the event that your order cannot be fulfilled for any reason, you will receive a full refund.
All Heirloom Prints products are handmade by Atkins Lab (Wm.G.Atkins Pty Ltd), a professional print laboratory based in Kent Town, South Australia, with over 85 years of industry experience. Atkins Lab produces each piece to our specifications using archival-grade materials.
Standard production time is 5–10 business days from the date your order is confirmed and your photograph is received in acceptable quality. Expedited production may be available upon request and may attract a surcharge.
Production timeframes are estimates. Heirloom Prints and Atkins Lab will use their best endeavours to meet advertised timeframes but cannot accept liability for delays outside of their reasonable control.
Orders are dispatched by Atkins Lab from South Australia via our nominated freight partners. Shipping costs are calculated at checkout based on your delivery address and selected service.
At this time, Heirloom Prints ships within Australia only. If this changes, these terms will be updated accordingly.
Every Heirloom Print is produced using archival-quality materials and is guaranteed for 100 years against:
The guarantee applies under normal indoor conditions and assumes:
To make a claim under the 100-year guarantee, contact us at info@heirloomprints.com.au with your order number and a description and photograph of the concern. We will assess the claim and, where valid, arrange for replacement production at no cost to you.
Our 100-year guarantee exists alongside — and does not limit — your rights under the Australian Consumer Law. See Section 7 for your statutory rights.
You retain full ownership and copyright of any photographs you upload to a Heirloom Prints storefront. By uploading a photograph, you grant Heirloom Prints a limited, non-exclusive licence to use the photograph solely for the purpose of producing your order.
The Heirloom Prints brand, storefront design, content, and all associated intellectual property remain the exclusive property of Heirloom Prints. You may not reproduce, copy, or adapt any element of our storefronts or materials without written permission.
By uploading a photograph, you confirm that you have the right to reproduce it for this purpose — whether as the photographer, the subject (or their guardian), or through having obtained appropriate permission. Heirloom Prints accepts no liability for copyright infringement arising from material provided by customers.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2). These guarantees are in addition to any rights you have under our 100-year guarantee.
Under the ACL, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
For details of our returns and refund process, please refer to our standalone Refund and Returns Policy.
To the extent permitted by law, Heirloom Prints' liability to you for any loss or damage arising from a product or service failure is limited to:
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
Heirloom Prints is not liable for indirect, incidental, or consequential losses except to the extent required by the ACL.
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, and the federal courts of Australia, as applicable.
Heirloom Prints may update these Terms from time to time. The current version will be published at heirloomprints.com.au/terms. Your continued use of any Heirloom Prints storefront after any change constitutes acceptance of the updated Terms.
